What To Do With Your Blood Sample

Storing Your Blood Sample Correctly

You should keep the sample in the sealed envelope in the fridge and seek advice from one of our motoring law solicitors without delay.

Having Your Own Sample Analysed

The law states that evidence of the proportion of alcohol or any drug found in a sample of blood or urine shall not be admissible unless the sample was divided at the time it was provided and (if requested) the other part was supplied to the accused.

Please inform us immediately if this requirement was not complied with in your case. If it was and you are now at home with your part of the sample you must follow our advice outlined above with regards to how the sample should be stored.

Having done that you should now contact our office without delay to seek advice from our Motoring Law Specialist.

We can advise you about the merits of having your own sample analysed by an independent analyst.

We can give you informed advice as to whether this is a step that should be considered prior to you finding out the outcome of the analysis carried out by the police or whether you should wait to see the outcome of that analysis first.

If we advise in favour of you having your sample analysed we will give you guidance as to what type of test should be undertaken.

The sample can tested for a range of drugs or simply tested for the presence of one particular drug.

We can liaise with a suitably qualified analyst from a laboratory that has the required industry benchmark that will ensure that any findings can be used in a court of law.

Prices vary depending on whether you require a screening test which simply detects whether the trace of a range of substances are present or whether a single test is required for a named substance or whether a full test is required for the six most commonly used substances.

Prices can vary again depending on whether a simple certificate is required confirming the presence and concentration of a substance or whether a detailed report is required from the toxicologist outlining his or her interpretation of the findings alongside other evidence in the case.

We will give you the right advice on such matters and ensure that you obtain the best price if you want to proceed with having your sample tested.
